Rhinehar convicted of murder, rape; faces possible life sentence

District Attorney Jan Scully announced today that Lamont Rhinehart was convicted by jury of first degree murder for the July 2007 rape and murder of Avery Polk.

On July 2, 2007, Ms. Polk was leaving her condominium when Rhinehart dragged her back into the condo and raped her. He then stabbed her multiple times, leaving her bleeding by the front door.

DNA evidence found at the scene was analyzed by the District Attorney’s Crime Lab and established that Rhinehart was responsible for the stabbing. Rhinehart stalked the victim over a period of four days before the murder.

Rhinehart was previously convicted in 2005 for a felony domestic violence assault on Avery Polk and had two prior domestic violence convictions involving a separate victim in 2000 and 2003.

Deputy District Attorney Ruanne Dozier states, "The jury diligently reviewed the evidence and reached the correct verdict in this case. This repeat domestic violence abuser will be held accountable for his years of violence against women.”

Rhinehart faces a sentence of life without the possibility of parole. Sentencing is set for April 15, 2011 at 3:00 p.m. in Department 33 of the Sacramento Superior Court.
