Palacio Convicted of Rape, Could Face 97 Years

District Attorney Jan Scully announced that Francis Palacio was convicted by jury of seven charges, including forcible sexual intercourse, oral copulation, sexual penetration with a foreign object, and kidnapping for the purpose of committing rape. The jury also found true allegations that Palacio kidnapped the victim during the commission of each offense.

On July 13, 2012, the victim was walking on Walerga Road near Kirkby Way when Palacio stopped her to ask what she was doing in the area. After a brief conversation, Palacio pushed her over the guardrail at the side of the road, goton top of her, and began strangling her when she screamed. When she attempted to wave for help,Palacio dragged her down the embankment out of the view of passing traffic.

He then committed forcible sexual acts against her and kicked her in the head multiple times before fleeing.The victim called 911, but responding Sacramento County sheriff’s deputies were not able to located Palacio. Palaciowas ultimately identified as a suspect through the use of DNA analysis performed by the Sacramento County District Attorney’s Crime Lab.

Deputy District Attorney Amy Holliday states, “I commend and thank Sacramento County Sheriff’s Detective Bradley Jones and District Attorney Victim Advocate Mailyn Chuong for their hard work and dedication to obtaining justice for this victim.”

Palacio faces a maximum sentence of 97 years to life in prison.Sentencing is set for February 21, 2014 at 1:30 p.m. in Department 3 before the Honorable Maryanne Gilliard.
